These terms and conditions govern the relationship between Konn Technologies Jordan (Konn Lil Tatbeqat Wal Khadamat Al Electronieh), a limited liability company incorporated under the laws of Jordan under No. 58113 (“Konn”) and any person utilizing Konn electronic DesignFit Report service (“Client”).The DesignFit Report service consist of a high level assessment of the buildability of a Konn Home on the Client’s chosen plot of land. The assessment includes matters relating to land topography and slope and the estimated technical and financial requirements for a potential residential project for the Client using Konn Home’s design and build products and services.By requesting or using the service, the Client agrees to be bound by these terms and conditions.
- DESIGN FIT REPORT SERVICE
- The electronic DesignFit Report service includes the following deliverables, as may be amended and/or updated by Konn from time to time:
- Topography and survey assessment.
- Assessment of zoning and municipal regulations.
- Floor layouts based on Client custom requirements.
- Site-fit of the house with exterior elements on site.
- Feasibility and rough cost estimate.
- Recommended next steps.
- The service shall be deemed completed upon Konn’s submission of the deliverables.
- The deliverables shall remain valid for a period of three (3) months from the date of submission, provided that no changes whether physical, legal, regulatory, or otherwise occur to the land during that period.
- The Client shall provide accurate information and any documents requested by Konn which will include official land documents not older than three (3) months from the date of submission. The Client shall be solely responsible for the accuracy, completeness, and validity of all information and documents provided.
- The Client shall provide Konn with full access to the land for the duration of the service.
- The Client may not change the location of the land or the project during the provision of the service. Any change in location will be treated as a new request and will be subject to separate fees.
- Payment of service fees shall be made in full upon acceptance of these terms and conditions. The service fees are inclusive of all applicable taxes and are non-refundable.
- The Client shall not have the right to terminate or cancel the service after accepting these terms and conditions.
- DISCLAIMERS AND LIMITATIONS
- The service and all deliverables are provided on an “AS IS” basis. Konn disclaims all warranties, whether express or implied, including, without limitation, any warranties of accuracy, completeness, currency, merchantability, or fitness for a particular purpose.
- The drawings, designs and materials provided under this service do not constitute engineering drawings and shall not be used for any construction, permitting, or other regulatory purposes.
- Konn shall not be liable for design work provided or any use of the deliverables for construction, engineering, design, or any other purpose.
- Any cost estimates provided by Konn are indicative only. The Client may verify such costs upon entering into a project agreement with Manazel Konn Le Inshaa Al Abnieh (Konn Homes).
- The prices and cost estimates provided are applicable solely within the Hashemite Kingdom of Jordan and shall not be relied upon for projects in any other jurisdiction.
- Konn shall not be liable for any delay or failure to perform, in whole or in part, resulting from any act or omission of the Client or from any cause beyond Konn’s reasonable control, including but not limited to force majeure events or third-party actions.
- Konn or its licensor retains all rights, title, and interest in and to the service and all deliverables, including without limitation all drawings, designs, reports, advice, concepts, ideas, materials, and any derivatives, updates, or modifications thereto (collectively, “Intellectual Property”). The Client is granted a limited, non-exclusive, non-transferable license to use the Intellectual Property solely for the Client’s own personal and non-commercial purposes. The Client shall not reproduce, share, sublicense, or commercially exploit the Intellectual Property without Konn prior written consent.
- The Client agrees to indemnify and hold Konn harmless from any loss, damage or claim arising from misuse of the deliverables or any breach of these terms and conditions.
- Konn reserves the right to subcontract any or all parts of the service at its sole discretion.
- The Client shall not assign or transfer any of its rights or obligations under these terms and conditions, whether in whole or in part, without Konn’s prior written consent.
- Parties shall maintain the confidentiality of any confidential information received during the provision of the service. Confidential information shall not be disclosed to any third party without prior written consent, except as required by law.
- Konn has the right to terminate the service if the Client breaches any of these terms and conditions or fails to cooperate reasonably. Upon termination, the Client remains liable for fees due and must return or destroy any confidential or intellectual property materials provided by Konn.
- Konn reserves the right to amend or update these terms and conditions at any time, with such changes becoming effective upon posting or otherwise providing notice to the Client. Continued use of the service after any such amendments constitutes acceptance of the updated terms and conditions.
- The governing law of these terms and conditions shall be the Jordanian law. Amman Courts (Palace of Justice) shall be the competent jurisdiction to settle any disputes between the parties hereto.
